TERMS AND CONDITIONS

The offer and sale of products on-line through the websites www.caffebonito.it, owned by Rn caffè srl, are regulated by the following General Conditions of Sale which are formulated in compliance with the Italian legislation pursuant to the Legislative Decree no. 206 of September 6th, 2005 (“Consumer Code”) and any other subsequent amendments and additions.

TRADE POLICY

Rn Caffè srl, with headquarters in Lucca, in Via di Tiglio 1697, registered in the Lucca Chamber of Commerce Companies’ Register under Tax code and VAT number 02391070469, the owner of the brand Bonito, (hereinafter Rn Caffè) offers its products for sale on the own website www.caffebonito.it and carries out e-commerce activities exclusively towards end-users, that is, final consumers or individuals acting for purposes unrelated to their entrepreneurial and professional activities, identified through the website www.caffebonito.it  (hereinafter Customer). In consideration of our trade policy, we reserve the right not to follow up on orders from different subjects to the Consumer or in any case to orders that do not comply with our above-mentioned trade policy.

By placing an order according to the rules, the Customer declares to have read all the information provided during the purchase procedure and to accept all the General Terms and Conditions of Sale. Rn Caffè reserves the right to modify the General Conditions of Sale by giving notice of it on this page of the site. The applicable General Conditions of Sale are those in force at the time of creation of the order by the customer. Any changes or updates will be effective only upon being posted on this website.

 

CHARACTERISTICS AND PRICES OF PRODUCTS OR SERVICES

The images of products may not be fully representative of their characteristics but may differ in color, size, accessory products represented. Any support information that may be provided during the purchase are intended merely illustrative and do not refer to real characteristics of the individual product. Products are offered for sale at the price indicated on the site on the date the order is placed. All prices are inclusive of VAT, the amount of which will be specified in the purchase invoice.

Prices do not include shipping and delivery costs which are, however, indicated in the final section, before submitting the order and specified in the order confirmation sent by e-mail to the Customer.


ORDER PLACEMENT

Orders can be subject to restrictions in terms of minimum or maximum quantity and products are offered within the limits of stock availability. Whether there is not sufficient capacity, the customer will be contacted directly by our staff.

No orders shall be accepted if submitted by parties who are not legally of age.

The various stages of placing the order and of concluding the purchase contract are clearly identified through text and informational graphics on the pages of the website that appear in sequence.

Once payment has been confirmed, the order can no longer be cancelled or modified.

The promotional codes proposed by RN Caffè, if any, are valid only for the products and period indicated at that particular moment. Promo codes are neither refundable or cumulative.

To take advantage of promotions and/or special offers related to such promotional codes, the Consumer is required to enter the promotional code in the space indicated on the site when confirming the order. Once the order has been confirmed, it cannot be canceled or renewed, in order to take the promotional code into consideration.


RECEIPT CONFIRMATION AND ACCEPTANCE OF ORDERS

Upon receipt of an order, Rn Caffè will automatically confirm its receipt to the Customer by e-mail, summarizing the details of the order itself.

Upon receipt of the order, Rn Caffè will check whether the product is available, only thereafter its acceptance and its shipment will be communicated.

In the event that Rn Caffè is unable to process the received order, it will promptly inform the Customer.

Any right of the customer to any damage compensation or refund, as well as any contractual or non-contractual liability arising from the rejection, even if partial, of any order, is hereby excluded.


ACCEPTED PAYMENT METHODS

Rn Caffè accepts payments only through the systems listed below:

  • Credit card (American Express, Visa or Mastercard); through the platform payment of …. The total amount of an order will be charged only at the time of the actual shipment of products.
  • PayPal: online payment system that allows any company or consumer who have an email address to send and receive payments, subject to registration. The payment is made through the PayPal payment platform.
  • Advance bank transfer: to a current account addressed to Rn Caffè;

SHIPMENT OF PRODUCTS

Rn Caffè will ship the purchased products exclusively to the address specified in the order.

Shipment to post office boxes is not accepted.

Rn Caffè shall deliver the products ordered by the Customer, by means of a courier, to the same address, indicated by the Customer at the time of the order, approximately within 48 working hours from the acceptance of the order. Delivery takes place generally within 5 working days. Time for delivery of the goods should be considered indicative. Delivery costs are charged on the basis of the rates specified on the site on the date the order. The recipient of the goods is responsible for paying any taxes and customs charges required under the legislation of the country to which the products are sent.

The courier company is responsible for the delivery. Rn Caffè agrees to receive any reports of failed or delayed deliveries of products through its site and, where appropriate, will support the Customer in exercising their legal rights.


CUSTOMER’S ACCEPTANCE OF THE PRODUCT

Possible damages to packaging and/or products or a missing number of packs or indications caused during transportation must be immediately notified by writing relevant remarks onto delivery receipt. By signing the courier shipping document, the Customer certifies the real outer integrity of the product and the conformity of the delivery. Any problems concerning the real integrity, correspondence or completeness of the delivered products must be reported within 10 working days from the delivery by sending an email to the address info@caffebonito.it or by calling 0583 980394.


INVOICING

Private Customers who enter their tax code will be issued an invoice for each order.

In order to emit the invoice, the information provided by the Customer at the time of the order will be faithfully reflected therein.  Once the invoice has been issued no modifications of the same will be possible. When ordering, it is necessary to indicate whether the address of delivery is different from the invoice address. If the private customer chooses not to enter his/her tax code, Rn Caffè will not issue an invoice or certify the payment by issuing a receipt (article 22, paragraph 1 of Presidential Decree 633/72 and article 2, letter oo) of Presidential Decree 696/96).


RIGHTS OF WITHDRAWAL AND RESTITUTION RULES

In execution of the provisions of Legislative Decree no. 21 of 21st February, 2014, implementing Directive 2011/83/EU on consumer rights, the Customer can return the purchased item and receive a refund of the purchase amount that has been actually paid.

The right of withdrawal can be exercised within 14 days from the delivery under the following conditions: Before the above-mentioned deadline, the Customer shall send a registered letter with acknowledgment of receipt to Rn Caffè or by presenting another explicit declaration to that effect. The communication can be sent, within the same term, by telegram or e-mail to info@caffebonito.it or by calling 0583 980394.

Subsequently, the Customer will be contacted by RN Caffè to arrange withdrawal of the goods to be returned.

The return of the product must take place within 14 days of receipt of the withdrawal notice. The refund of the price paid for the purchase of the product includes shipping costs.

If the product value has deteriorated due to inappropriate handling, for a reason attributable to the Customer, (in particular: damaged products, irregular or incomplete packaging, damaged or incomplete components, elements, accessories, packaging materials, boxes, documentation and/or other objects), RN Caffè will refund the Customer the purchase value minus a decrease amount.

In case the Customer sends back products after the deadline or in case of opened and/or partially used products which are not suitable for being returned, the right of withdrawal does not apply and RN Caffè will return the purchased goods to the Customer, charging the shipping costs to the Customer.

With the above-mentioned limitations, Rn Caffè will refund the amount actually paid by the Customer within 14 days from receipt of the notice of withdrawal by crediting the current bank account, Paypal account, or the credit card.


WARRANTY

All products, other than foodstuffs, sold on the website by RN Caffè, carry a standard Manufacturer warranty and a 24-month warranty from the delivery date for non-conformities in accordance with the legislative Decree no. 24 of 2002 and subsequent articles and amendments 130 and 132 of Legislative Decree no. 206 of 2005.

In order to receive warranty service, the customer must keep and store the invoice or, at least, the consignment note.

If the purchased product is found to have manufacturing defects and/or has been damaged during the transportation, the Customer may request its replacement within 10 days of receipt by telegram, or email to the following address: info@caffebonito.it or by calling the number 0583 980394.

The Customer is also required to return the defective or damaged product in its original intact packaging in all its parts.

In case of replacement of the product, the return shipping costs are paid by Rn Caffè which will replace the product with an identical one or, if the product is out of stock and with prior Customer’s agreement, with one of equivalent value.


CURRENT LAW AND PLACE OF JURISDICTION

The sale of products and/or services takes place in the territory of the Italian State and is subject to the laws in force in the Italian Republic. The place of jurisdiction for the resolution of any dispute will be that provided by the Italian legislation in force at the time of conclusion of the contract.
